 Be Brave Travel – Terms & Conditions

Effective date: 25th August 2025  |  Version: 1.0  |  Legal Name of Agency: Be Brave Travel (the “Agency”)


Important Notice: These Terms & Conditions (the “Terms”) govern the relationship between you (“Client/Traveler/You”) and Be Brave Travel. The Agency acts as a booking agent for independent suppliers. By authorizing payment, signing any authorization, or otherwise booking travel through the Agency, you acknowledge that you have read, understood, and agree to be bound by these Terms and by the applicable supplier terms and conditions.
 

1) Our Role as Agent

Be Brave Travel arranges travel services provided by third‑party suppliers (airlines, cruise lines, hotels, tour operators, insurance providers, transfer companies, etc.). We do not own, manage, or control these suppliers and are not responsible for their acts, errors, or omissions. Supplier terms (including payment, cancellation, change, and refund policies) govern your booking in addition to these Terms.


2) Quotes, Pricing & Availability

  • All prices are dynamic and subject to change until paid in full and confirmed by the supplier. Currency fluctuations, tax changes, fuel surcharges, and resort/port fees may change total trip cost.
     
  • Unless specifically stated, quotes do not include: resort fees, local taxes, visas, vaccinations, tips/gratuities, seat assignments, checked baggage, incidentals, or optional activities.
     
  • Promotional offers may have capacity controls, blackout dates, or additional restrictions.
     

3) Deposits, Payments & Deadlines

  • A deposit (per supplier rules) is required to secure a reservation. Payment schedules and final due dates are dictated by suppliers.
     
  • Missed or late payments may result in automatic cancellation by the supplier with loss of funds per supplier policy.
     
  • You authorize the Agency to transmit your payment to suppliers on your behalf. The Agency may collect non‑refundable service fees (planning/booking/changes) separate from supplier costs.
     
  • If using third‑party financing/“pay over time,” approval, rates, and terms are determined by the lender. Financing does not change supplier deadlines or penalties.
     

4) Cancellations, Changes & Refunds

  • All cancellations/changes must be requested in writing to the Agency and are subject to both Agency service fees and supplier penalties.
     
  • Refund eligibility is determined solely by each supplier; many fares and rates are non‑refundable. The Agency’s service fees are non‑refundable.
     
  • After travel begins, unused services are typically non‑refundable. No‑shows are non‑refundable.
     

5) Travel Insurance (Strongly Recommended)

We strongly recommend purchasing comprehensive travel insurance (trip cancellation/interruption, medical, evacuation, baggage, CFAR where available). If you decline insurance, you assume the risk of financial loss. A signed waiver may be required if you refuse coverage.


6) Documentation, Entry & Health Requirements

  • You are responsible for complying with all entry/exit, visa, passport, vaccination, testing, and health requirements for your destinations and transit points. Passports are generally recommended to have 6+ months validity beyond your return date and sufficient blank pages.
     
  • Requirements can change at any time; verify with official government sources before departure. The Agency is not liable for denied boarding or entry for failure to meet requirements.
     

7) Accessibility, Special Needs & Alcohol‑Free Preferences

  • The Agency advocates for inclusive travel and will request accommodations (mobility, sensory, dietary, medical refrigeration, etc.) and sober‑friendly options where possible. However, accessibility features and alcohol‑free offerings vary by supplier and destination and cannot be guaranteed.
     
  • You must disclose medical, mobility, dietary, or accessibility needs in writing during trip planning so we can advise options. Some activities may have age/height/weight/fitness limitations.
     
  • For sober/alcohol‑free preferences: many venues serve alcohol to the general public; “alcohol‑free” refers to curated experiences, beverage options, or community guidelines—not an alcohol‑free environment. The Agency cannot control other guests’ behavior or venue policies.
     

8) Health, Fitness & Assumption of Risk

Travel involves inherent risks (illness, injury, crime, weather, transportation issues, pandemics, natural disasters, strikes, etc.). You assume all risks and are responsible for determining whether travel and specific activities are appropriate given your health and fitness. Consult your medical provider as needed. Follow all supplier safety instructions.


9) Air Travel, Baggage & Schedule Changes

  • Airlines may change schedules, routes, aircraft, or seats without notice. You are responsible for reconfirming flights, checking in on time, and complying with baggage rules/fees.
     
  • If flights are delayed/canceled, remedies are subject to airline policy. The Agency will assist where possible but is not responsible for costs due to airline actions.
     

10) Hotels/Resorts/Cruises & Incidental Charges

Check‑in policies, incidental deposits, resort fees, and room assignments are controlled by the supplier. Specific bedding/room views are requests, not guarantees, unless explicitly confirmed in writing by the supplier.


11) Groups

For group travel, the group contract governs (rooming lists, attrition, release dates, concessions). The Group Leader is responsible for disseminating information and collecting payments from participants unless otherwise specified. Unused space may be released at deadlines.


12) Credit Card Authorization & Chargebacks

By providing a payment method, you authorize charges to suppliers and to the Agency for service fees. You agree not to file chargebacks for supplier penalties, no‑show, or non‑refundable amounts disclosed to you. If a chargeback is initiated and reversed in the Agency’s favor, you agree to reimburse all related fees and costs.


13) Force Majeure

The Agency and suppliers are not liable for failure or delay in performance due to events beyond reasonable control, including but not limited to acts of God, weather, epidemics/pandemics, government actions, war, labor disputes, or mechanical issues. Remedies are governed by applicable supplier policies.


14) Limitation of Liability

To the maximum extent permitted by law, the Agency’s aggregate liability shall not exceed the total Agency service fees paid by you for the booking giving rise to the claim. The Agency is not liable for indirect, incidental, special, or consequential damages.


15) Indemnification

You agree to indemnify and hold harmless the Agency, its owners, and employees from any claims, damages, or expenses arising out of your acts/omissions, violations of these Terms, or claims related to suppliers or third parties.


16) Data & Privacy

We collect and share personal data (names, DOB, passport details, contact info, preferences, medical/ accessibility notes you provide) with suppliers solely to fulfill travel services. See our Privacy Notice at: https://bebravetravel.com/privacy-statement. Do not provide data you are not authorized to share.


17) Photos, Testimonials & Community Guidelines

You grant the Agency permission to use non‑identifying travel photos/testimonials you voluntarily provide for marketing, unless you revoke consent in writing. Group trips may adopt community guidelines (inclusion, respect, sober‑friendly norms) which participants agree to follow; violation may result in removal at your expense.


18) Communications Consent

You consent to receive transactional communications related to your booking via email, phone, SMS, and messaging apps. You may opt out of marketing messages at any time.


19) Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New York without regard to conflict‑of‑law rules. Prior to filing any claim (other than small‑claims court), parties agree to attempt good‑faith resolution, then non‑binding mediation in Suffolk County, NY. If unresolved, disputes shall be resolved by binding arbitration in Suffolk County, NY, administered by a recognized arbitration service. Each party bears its own costs; prevailing‑party attorneys’ fees may be awarded as permitted by law. You may bring qualifying claims in small‑claims court instead of arbitration.


20) Severability & Entire Agreement

If any provision is found unenforceable, the remainder remains in effect. These Terms, together with applicable supplier terms, constitute the entire agreement regarding your booking and supersede prior understandings.


21) Acceptance

Your authorization of payment, signature (wet or electronic), click‑wrap acceptance, or continued use of Agency services constitutes acceptance of these Terms. If booking on behalf of others, you represent that you are authorized to accept on their behalf and agree to provide these Terms to all travelers on the reservation.
